Critical Warning for Online Sellers: Protect Your Business on Etsy and Thrive in the Competitive Online Marketplace

Today on Instagram I warn about a disturbing new trend: unscrupulous companies that are trademarking innocuous words and then going after small online sellers, particularly on Etsy, who inadvertently use those words.
A recent lawsuit highlighted the company that trademarked the smiley face as well as the word "smiley" and then caused sellers' shops to be shut down and held for ransom if they used the word smiley in their listings, even without the trademarked face.
This practice comes on top of numerous reports of large corporations violating the Fair Use Law by suing resellers who legally resell their brands. North Face and Chanel have been using this practice. Although it's actually illegal, these large corporations and their lawyers prey on small individual sellers who don't have the funds to fight back.
